Please read these Terms and Conditions carefully before using the Elton Browne Photography website or enrolling in any of our courses, memberships, or services. By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part, you may not access the Service.

1. Interpretation & Definitions

Interpretation

Words with an initial capital letter have meanings defined under the following conditions. These definitions apply regardless of whether they appear in singular or plural form.

Definitions

  • "Company" (referred to as "We", "Us", or "Our") refers to Elton Browne Photography, operating under the tradename Korsou Scenery, registered with the Curaçao Chamber of Commerce under registration number 67741 and CRIB number 102.108.328, located in Willemstad, Curaçao.
  • "Course" refers to the EltonBP Photography Foundations Course, an online educational program offered by the Company.
  • "Enrollment Date" means the date on which payment is successfully processed and confirmed, at which point access to Course materials is activated.
  • "Membership" refers to the Silver Club or Gold Club subscription plans offered on a monthly or annual billing basis.
  • "Certificate" refers to the EltonBP Photography Foundations Certificate of Completion, issued upon achieving a cumulative assessment score of 80% or higher.
  • "Digital Product" means any downloadable photography file, print, or digital asset sold through the Company's Digital Store.
  • "Physical Product" refers to apparel, accessories, or merchandise sold through the Company's Product Store.
  • "Service" refers to the Elton Browne Photography website at eltonbrownephotography.com and all products and services offered therein.
  • "You" means the individual accessing or using the Service.
  • "Workshop" refers to in-person or field-based photography workshops held in Curaçao by the Company.

2. Acknowledgment

These Terms and Conditions govern the use of this Service and the agreement between You and the Company. They set out the rights and obligations of all users, students, and members.

By accessing or using the Service — including enrolling in a Course, joining a Membership, purchasing a Digital or Physical Product, or booking a photography service — You agree to be bound by these Terms in their entirety.

You represent that You are over the age of 18. The Company does not permit those under 18 to use the Service or enroll in any paid programs without verified parental consent.

Your use of the Service is also subject to the Company's Privacy Policy and Cookie Policy.

3. Website Use

The content of this website — including all photographs, videos, text, course materials, and design elements — is for general informational and commercial purposes. Use of the Service is at your own risk.

You may not use the Service in any way that is unlawful, harmful, fraudulent, or that infringes the rights of the Company or any third party. Prohibited conduct includes but is not limited to: scraping content, distributing malware, impersonating another person or entity, or circumventing security measures.

The Company reserves the right to restrict or terminate access to the Service for any user who breaches these Terms, without prior notice or refund.

4. Photography Services

Commercial photography services — including product shoots, event photography, café and restaurant photography, and consultation sessions — are subject to separate service agreements confirmed via the Company's booking and quotation process.

By booking a photography session or consultation, You agree that any deposit paid is non-refundable upon cancellation made within 48 hours of the scheduled session. Session rescheduling may be accommodated subject to availability.

All photographic work produced by the Company remains the intellectual property of Elton Browne Photography unless a specific licensing agreement has been signed. Delivery of final images does not constitute transfer of copyright. See Section 11 (Intellectual Property) for full details.

5. Course Enrollment Terms

5.1 Enrollment

Enrollment in the EltonBP Photography Foundations Course is completed when You select a payment plan, provide valid payment information, and payment is successfully processed. Your Enrollment Date is the date on which this transaction is confirmed — this date governs your refund eligibility window (see Section 7) and the start of your course access period (see Section 6).

An enrollment confirmation email will be sent to the address provided at checkout. Please retain this email as it contains your Enrollment Date and order reference, which may be required for any refund requests.

5.2 Payment Plans

The Course is available under the following payment options:

  • One-time payment: USD $149.00 — full access activated immediately upon payment
  • 3-payment installment plan: 3 monthly payments of USD $52.99 — access activated upon receipt of the first payment

Membership discounts (5% Silver Club, 10% Gold Club) are applied at checkout using the discount code provided to active members.

5.3 Assessment & Certificate

To earn the EltonBP Photography Foundations Certificate of Completion, You must achieve a cumulative average score of 80% or higher across all module assessments. The certificate is issued automatically upon meeting this threshold. There is no limit on the number of assessment attempts within your active access period.

The Certificate is a mandatory prerequisite for enrollment in the EltonBP Intermediate Professional Course and for registration at all Company-organised workshops in Curaçao.

5.4 Course Content

The Company reserves the right to update, modify, or supplement course content at any time to reflect improvements, corrections, or curriculum changes. Such changes do not constitute grounds for a refund where the core subject matter and learning objectives of the Course remain materially unchanged.

6. Course Access Duration

Course access is tied to an active membership subscription. Access continues for as long as the membership remains active, and for a defined grace period after cancellation to allow students to complete work already in progress.

6.1 Silver Club Access

Silver Club members have full, on-demand access to all course materials for the duration of their active membership. Upon cancellation, course access continues for a 60-day grace period from the cancellation date. Once the grace period expires, access is suspended. Reactivating a Silver Club membership restores full course access immediately.

6.2 Gold Club Access

Gold Club members have full, on-demand access to all course materials plus exclusive bonus videos available only to Gold Club subscribers. Upon cancellation, course access continues for a 120-day grace period from the cancellation date. Once the grace period expires, access is suspended. Reactivating a Gold Club membership restores full course access immediately.

6.3 Certificate Completion During Grace Period

Students may still complete assessments and earn their Certificate of Completion during the applicable grace period. The certificate, once issued, remains valid permanently and is not affected by subsequent membership status.

6.4 Access Suspension & Reactivation

When course access is suspended, all progress, assessment scores, and completed unit records are retained and restored in full upon reactivation. No progress is lost during a period of suspended access. Students may reactivate at any time by subscribing to a Silver or Gold Club membership plan.

6.5 General Access Conditions

Course access is provided on an on-demand, self-paced basis with no live attendance requirements. Access is provided to one (1) registered user account per enrollment. Sharing login credentials, redistributing course content, or allowing third-party access to your account is strictly prohibited and may result in immediate termination of access without refund.

7. Refund Policy

7.1 Course Enrollment — 7-Day Refund Guarantee

The Company offers a 7-day no-questions-asked refund on the EltonBP Photography Foundations Course. If You are not completely satisfied for any reason, You may request a full refund within the first seven (7) calendar days of your Enrollment Date.

Course Refund — At a Glance

  • Full refund available within 7 calendar days of your Enrollment Date
  • Applies to the one-time course fee of USD $149.00
  • Applies to the first installment ($52.99) of the 3-payment plan
  • No reason required — simply contact us within the 7-day window
  • Refund requests submitted after 7 days from Enrollment Date cannot be processed
  • Membership fees (Silver Club and Gold Club) are not refundable — see Section 7.4
  • Subsequent installments of the 3-payment plan are non-refundable once the 7-day window has passed

7.2 How to Submit a Refund Request

To request a refund, contact the Company within 7 calendar days of your Enrollment Date via the Contact page with the subject line: "Course Refund Request."

Your request must include:

  1. Your full name as registered at enrollment
  2. Your enrollment confirmation email or order reference number
  3. Your Enrollment Date
  4. The email address used to create your account

The Company will acknowledge your request within 2 business days of receipt.

7.3 Refund Processing Timeline

Once a valid refund request is approved, the Company will process the refund within 5 to 10 business days. Refunds are issued to the original payment method. The Company is not responsible for additional processing delays imposed by your bank or card issuer, which may add 3–5 business days.

7.4 Exclusions — Membership Fees

Silver Club and Gold Club membership fees are non-refundable once a billing cycle has commenced. This applies to both monthly and annual plans. You may cancel at any time (see Section 8.3) and benefits continue until the end of the current paid billing period. No partial refunds are issued for unused membership time within a billing cycle.

7.5 Digital Products

Digital photography prints and downloadable files are non-refundable once the download has been initiated. If you experience a technical issue preventing download, contact the Company for assistance or a replacement.

7.6 Physical Products

Physical merchandise may be returned within 14 days of receipt in unused, original condition. See the applicable Return Policy (USA) or Return Policy (Rest of World).

7.7 Photography Session Deposits

Deposits paid to secure a photography session or workshop booking are non-refundable upon cancellation within 48 hours of the scheduled date. Cancellations with more than 48 hours' notice may be transferred to a rescheduled date, subject to availability.

8. Membership Terms

The Company offers two membership tiers — Silver Club and Gold Club — on monthly or annual billing cycles. By subscribing, You agree to the following terms.

8.2 Billing

Membership fees are billed automatically at the start of each billing cycle. By subscribing, You authorise recurring charges to your selected payment method until cancellation. The Company reserves the right to adjust membership pricing with a minimum of 30 days' written notice to active members.

8.3 Cancellation

You may cancel your membership at any time via your account settings or by contacting the Company. Cancellation takes effect at the end of the current paid billing period — You retain full membership benefits, including course access, until that date. No partial refunds are issued for unused time within a billing cycle.

Upon cancellation, course access transitions into the grace period defined in Section 6: 90 days for Silver Club members and 180 days for Gold Club members, measured from the cancellation date. All course progress and scores are preserved during any suspension and restored immediately upon reactivation.

8.4 Membership Discount Codes

Discount codes provided to members are valid only during an active membership period. Codes are for single use, non-transferable, and may not be combined with other promotions unless explicitly stated.

9. Digital Products & Downloads

Digital photography prints and image files sold through the Digital Store are licensed for personal use only unless a separate commercial license has been purchased. See Section 11 for licensing terms.

Digital products are delivered via secure download link after payment confirmation. Digital products are non-refundable once downloaded. See Section 7.5 for full details.

10. Physical Products & Returns

Physical products — including apparel, accessories, and merchandise — are subject to the following conditions:

  • Returns accepted within 14 days of receipt for items that are unused, unworn, and in original packaging
  • Items damaged after receipt or worn beyond original inspection are not eligible for return
  • Reimbursement is made within 14 days of receiving returned goods via the original payment method
  • Goods made to your specifications or clearly personalised are not eligible for return

11. Intellectual Property

All photographs, videos, course materials, written content, logos, and design elements on this website are the exclusive intellectual property of Elton Browne Photography and are protected by applicable copyright law.

Personal Use: Digital products purchased from the Digital Store are licensed for personal, non-commercial use only.

Commercial Use: Any use of Elton Browne Photography images for commercial purposes requires a separate written licensing agreement. Contact the Company via the Licenses page.

Course Materials: All course videos, presentations, and assessment materials are proprietary. You may not reproduce, distribute, resell, or share course materials with third parties in any form.

It is strictly prohibited to reproduce any picture or video from this website without obtaining prior written consent from Elton Browne.

12. Placing Orders

By placing an Order through the Service, You warrant that You are legally capable of entering into binding contracts and that all information You provide is true, correct, and complete.

We reserve the right to refuse or cancel any Order at any time for reasons including product unavailability, pricing errors, or suspected fraudulent transactions. Any payment received will be refunded in full.

Accepted payment methods include Visa, MasterCard, American Express, and PayPal. The Company is not liable for non-delivery resulting from failed card authorisation.

13. Links to Other Websites

Our Service may contain links to third-party websites not owned or controlled by the Company. The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party sites.

14. Termination

We may terminate or suspend Your access immediately, without prior notice or liability, for any reason including breach of these Terms. Termination due to breach — including unauthorised sharing of course content or account credentials — will not entitle You to a refund under Section 7.

15. Limitation of Liability

To the maximum extent permitted by applicable law, the Company's total liability to You for any claim shall not exceed the amount actually paid by You to the Company in the twelve (12) months preceding the claim.

In no event shall the Company be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, loss of data, or business interruption — even if advised of the possibility of such damages.

The Service is provided "AS IS" and "AS AVAILABLE" without warranty of any kind.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Curaçao, Kingdom of the Netherlands. Any disputes shall be subject to the exclusive jurisdiction of the courts of Curaçao, unless otherwise required by the mandatory consumer protection laws of your country of residence.

17. Disputes Resolution

If You have any concern or dispute regarding the Service, You agree to first attempt to resolve the matter informally by contacting the Company directly via the Contact page. The Company will make good-faith efforts to resolve disputes within 14 business days of receiving written notice.

18. Severability & Waiver

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

Waiver

The failure to exercise or enforce any right under these Terms shall not constitute a waiver of that right.

Translation

These Terms may be translated for convenience. In the event of any conflict between a translated version and the original English text, the original English text shall prevail.

19. Changes to These Terms

The Company reserves the right to modify these Terms at any time. If a revision is material, We will provide at least 30 days' notice prior to the new terms taking effect — via email to registered users or via a prominent notice on the website. By continuing to use the Service after revisions take effect, You agree to be bound by the updated Terms.
